Panamanian girl whose father illegally kept her in Costa Rica, returned to her mother

Panamanian girl whose father illegally kept her in Costa Rica, returned to her mother

A 9-year-old minor was handed over on Tuesday to her Panamanian mother, after having been kept "illegally" under her authority in Costa Rica for more than a year by her Iranian father.
The judicial proceeding was carried out within a protection measure requested by the legal representative of the girl's mother, where the Court, with the favorable opinion of the MP, ordered the Ministry of Health to generate the corresponding safe-conduct to receive the minor in our country, complying with the respective sanitary parameters in the midst of the Coronavirus crisis.

“Through the Section of Civil, Agrarian and Family Affairs of Chiriquí, the Prosecutor Everardo González Benavides, and the First Sectional Family Court of Chiriquí, in charge of Judge Nurys Philides, carried out the judicial process in the Border of Panama with Costa Rica, where the reception and delivery of the minor to her mother was successfully achieved, ”the Public Ministry said in a statement.

In addition, it was decided to establish the Tribunal on the border with Costa Rica in order to guarantee that the reception and delivery would take place in compliance with their fundamental rights.

According to the MP, the Costa Rican Courts ruled that the minor should be returned to Panama, having been “unlawfully detained by the father in Costa Rica since January 2019, when he took her on there vacation. He never returned her to her mother, who legally maintains parental authority. ”

Due coordination of the Panama Ministry of Foreign Affairs, the National Immigration Service and the National Secretariat for Childhood, Adolescence and Family, and Costa Rican National Board of Children, the same day compliance with court orders from both countries was carried out.

"Through criminal proceedings, an investigation is ongoing against the girl's father for the crime of illegal removal of minors," said the MP.

In this type of process, the MP participates as a representative of the State, and since Panama is a subscriber to the Convention on Civil Aspects of International Child Abduction, it is up to the Public Vindicta to participate in these processes as impartial guarantors of the observance of the rights of citizens.
