Ricardo Alberto Martinelli Linares withdraws from the amparo that stopped his extradition process

Ricardo Alberto Martinelli Linares withdraws from the amparo that stopped his extradition process

The Guatemalan CSJ is expected to file the amparo and return the file so that the Third Criminal Sentencing Court can set a hearing date.
The defense of Ricardo Alberto Martinelli Linares, detained in Guatemala, withdrew from an injunction that until now had stopped his extradition process to the United States.

Now it is expected that the Supreme Court of Justice of Guatemala will file the amparo, and return the file so that the Third Criminal Sentencing Court can set a hearing date and continue the process to determine whether Ricardo Alberto Martinelli Linares is sent to the United States or not.

"On August 9 of the current year, I was notified of the resolution of June 29 of the year two thousand twenty-one. However, because it was in my best interest and having made the decision to passively submit to the extradition process, in a I voluntarily and spontaneously request to desist from the constitutional protection action identified with the number 1525-2020," indicates Ricardo Alberto Martinelli Linares.

Recently, the Guatemalan Ministry of Foreign Affairs sent the file with the extradition authorization of his brother Luis Enrique Martinelli Linares to the United States embassy in that country.

Luis Enrique Martinelli Linares and Ricardo Alberto Martinelli Linares are currently being held in preventive custody at the Mariscal de Zavala Military Base jail, after being captured on July 6, 2020 at La Aurora Airport, where they would take a flight to Panama.

The Martinelli Linares brothers were arrested on the basis of an extradition order issued by the United States, for their alleged participation in a massive bribery scheme and money laundering from the Brazilian construction company Odebrecht.
